§ 98-416. Municipal stormwater utility system rate schedule.

  • (a)

    The city council hereby establishes drainage charges to be paid by users of benefited property in the service area of the drainage utility. The determination of the schedule of drainage charges is deemed nondiscriminatory, reasonable and equitable to provide regional detention and retention ponds, watershed protection, land purchase, waterway enlargement, channelization, improved conveyance structures and administration of the drainage utility. The schedule of authorized drainage charges shall be approved from time to time by resolution of the city council. Such drainage charges shall be based on the following rate structure:

    (1)

    Single-family residential. All single-family residential properties shall be assessed a flat base fee.

    (2)

    Multifamily residential. All multifamily residential properties shall be divided into units for purposes of fee assessment. Each 1,700 square feet of livable area, as reflected in the records of the Tarrant County Appraisal District, shall be considered one unit for purposes of the utility with all areas in excess thereof rounded to the next highest multiple of 1,700. Each multifamily residential unit shall be assessed a flat base fee.

    (3)

    Commercial/industrial. All commercial/industrial properties shall be divided into units for purposes of fee assessment. Each 5,140 square feet of area, as reflected in the records of the Tarrant County Appraisal District, shall be considered one unit for purposes of the utility with all areas in excess thereof rounded to the next highest multiple of 5,140. Each commercial/industrial unit shall be assessed a flat base fee.

    (b)

    Property classifications of "single-family residential", "multifamily residential", and "commercial/industrial" shall be defined based on the state use code employed by the Tarrant County Appraisal District. As property designations are added to the state use code, this article may be amended accordingly. The property classifications referenced in subsection (a) hereof, shall include the following:

    (1)

    Properties designated as A1, A5, A9, E1, M3 and O2 will be considered "single-family residential" for purposes of this article.

    (2)

    Properties designated as B1, B2 and B4 will be considered "multifamily residential" for purposes of this article.

    (3)

    Properties designated as F1, F2, J2, J3, J5 and J6 will be considered "commercial/industrial" for purposes of this article.

    (4)

    Properties designated as C1, C2, C3, C6, D1, D3, D4 and O1 shall be considered undeveloped and will not be assessed a fee.
