§ 70-33. Non-profit and charitable organization sales.

  • The requirements set forth in this section shall apply only to garage sales conducted by non-profit and charitable organizations:

    (1)

    Such sales shall not exceed two in a calendar year by any one non-profit or charitable organization.

    (2)

    No more than four non-profit or charitable organization garage sales may be conducted on the same property in any one calendar year.

    (3)

    A garage sale conducted pursuant to this section shall not exceed one day in duration.

    (4)

    Notwithstanding the requirements of division 2 of this article, an application for a garage sale permit under this section must be submitted to the office of the city secretary at least seven days prior to the proposed date of the sale. There shall be no cost associated with an application for a garage sale permit under this section.

    (5)

    The application must be signed by the owner of the property indicating that the owner has granted the non-profit or charitable organization permission to conduct the sale on the property and acknowledging that no more than four non-profit or charitable organization garage sales per calendar year may be conducted on the property.

    (6)

    Only one sign advertising the garage sale is permitted and the sign must be located on the property where the sale will be conducted. The sign shall be issued by the city.

    (7)

    No structure, sales table, or sales item may be located within any street right-of-way or be placed in such a manner as to obstruct traffic visibility.

    (8)

    Vehicles may not be parked in such a manner as to obstruct the orderly flow of vehicular traffic on public streets.

    (9)

    All items associated with the garage sale must be removed from public display on the property by 8:00 p.m. on the date of the garage sale.

    (10)

    Non-profit and charitable organizations may not conduct garage sales at apartment complex properties within the city.

    (11)

    Non-profit and charitable organizations shall not be required to comply with the requirements set forth in section 70-32.

    (12)

    To the extent of a conflict with the language in subsection 8-7 C. of the city's zoning ordinance, governing permitted special events, this section shall control.
