§ 30-132. Certain uses prohibited.

  • The following acts, among others, are declared to be nuisances in violation of this chapter, but such enumeration shall not be deemed to be exclusive of other noises as defined in section 30-131:

    (1)

    The use of any stationary or portable loudspeaker or amplifier of such intensity that it annoys and disturbs persons of ordinary sensibilities in the immediate vicinity thereof;

    (2)

    The use of any stationary or portable loudspeaker or amplifier between the hours of 9:00 p.m. and 7:00 a.m. on any weekday or at any time on Sunday;

    (3)

    The use of any stationary or portable loudspeaker or amplifier at any time on the outside of any residential building in a residential area;

    (4)

    The playing of any radio, television, phonograph or other musical instrument in such manner or with such volume as to annoy or disturb the quiet, comfort or repose of persons of ordinary sensibilities in any dwelling, hotel, motel or other type of residence;

    (5)

    The playing of any radio, television, phonograph or other musical instrument in any residence or residential area, between the hours of 9:00 p.m. and 7:00 a.m., in such manner or with such volume as to be disturbingly audible to persons of ordinary sensibilities located on the outside of the residence or off the residential premises where it is being played;

    (6)

    The continued or frequent sounding of any horn or signal device on any automobile, motorcycle, bus or other vehicle except as a danger or warning signal;

    (7)

    The use of any signal device, except for necessary warning of danger, making an unreasonably loud or harsh noise or continuing for an unreasonable period of time;

    (8)

    The keeping of any animal or bird which, by causing frequent or long-continued barking, crying or noise, disturbs the comfort and repose of any person of ordinary sensibilities in the immediate vicinity;

    (9)

    The running of any automobile, motorcycle or other vehicle so out of repair, loaded or in such manner to create loud or unreasonable grating, grinding, jarring or rattling noises or vibrations;

    (10)

    The blowing of any steam whistle attached to any stationary boiler except to give notice of the time to begin or stop work or as a warning of danger;

    (11)

    The discharge into the open air of the exhaust of any steam engine, internal-combustion engine, motor vehicle or other combustion device except through a muffler or other mechanical means, properly maintained, which will effectively prevent loud or explosive noises therefrom;

    (12)

    The blowing or sounding of any steam whistle, horn or other signal device on any engine, locomotive car or vehicle adapted to railroad travel, except as a warning or danger signal to persons or animals approaching, crossing or using the tracks of the railroad;

    (13)

    The use of any mechanical device operated by compressed air, unless the noise to be created is effectively muffled and reduced;

    (14)

    The use of any drum, loudspeaker or other instrument or device for the purpose of attracting attention to any performance, show or sale of merchandise;

    (15)

    The raucous shouting and crying of peddlers, hawkers and vendors which disturbs the peace and quiet of the neighborhood;

    (16)

    The erection, including excavation, demolition, alteration or repair work, on or of any building other than between the hours of 6:00 a.m. and 9:00 p.m. on weekdays, except in case of urgent necessity in the interest of public safety and convenience, and then only by permit from the city council, which permit may be renewed by the city council during the time the emergency exists and conditioned in such manner as the city council shall determine to be most in the public interest.
