§ 1-13. General penalty for violations of Code; continuing violations.

  • Whenever in this Code or in any ordinance of the city an act is prohibited or is made or declared to be unlawful or an offense or a misdemeanor, or wherever in such Code or ordinance the doing of any act is required or the failure to do any act is declared to be unlawful, and no specific penalty is provided therefor, or a specific penalty was heretofore less than the range of punishment hereafter set forth, the violation of any such provision of this Code or any such ordinance of the city shall henceforth be punishable, upon conviction, by fine as follows:

    (1)

    For violation of Code or ordinance provision that governs fire safety, zoning, or public health or sanitation, including dumping of refuse, a fine in any amount not less than $1.00 nor more than $2,000.00 for each such violation.

    (2)

    For violation of any other Code or ordinance provision, a fine of not less than $1.00 nor more than $500.00 for each such violation.

    (3)

    Provided, however, that no such fine or penalty shall be greater or less than that provided by laws of the state for the same offense.

    (4)

    Each day or fractional part of any day that any such violation continues shall constitute a distinct and separate offense from the previous violation of any provision of this Code or any ordinance of the city.
