§ 10-1. General.

  • The following regulations shall apply to retirement housing units at the time of initial approval of a special use permit and for the duration of occupancy by qualified residents.

    A.

    Criteria for qualification. To qualify under these regulations as retirement housing, a development shall provide dwelling units specifically designed for the needs of ambulatory elderly persons, a minimum of 80 percent of the total units shall have a household head of 60 years of age or older. The remaining units shall meet one of the following conditions:

    1.

    The household head is 55 years of age or older;

    2.

    A unit is occupied by the surviving member(s) of a household, regardless of age and the household head meeting the age requirements has died;

    3.

    A unit is occupied by management personnel and his/her family (the total of such dwelling units shall not exceed one per 100 dwelling units, or portion thereof, in the project).

    B.

    Certification of compliance. The owner/operator of any complex developed under the regulations shall annually on the anniversary date of the issuance of the certificate of occupancy, submit certification to the building inspector that the development is in compliance with these regulations. Such certifications shall include:

    1.

    The ages of the heads of household of each dwelling unit.

    2.

    Documentation that those heads of households not complying with Item 1, qualify for residence under subparagraph B(9)(a) above.

    3.

    The number of cars belonging to occupants of each dwelling unit.

    4.

    The number of owner-occupied units.

    C.

    Failure to comply with conditions of this section.

    1.

    The building inspector shall revoke the certificate of occupancy if any of the dwelling units (other than a maximum of one per 100 units specifically identified for occupancy by management personnel) are occupied by heads of household who do not comply with the age requirements previously herein stated for this use.

    2.

    In addition, if the total number of cars belonging to occupants exceeds a number which is equal to one-half of the total number of renter-occupied dwelling units contained within the development, then the owner/operator shall within 14 days of the date of said certification, submit for approval by the planning and zoning commission and city council, a revised site plan showing the location of sufficient additional car parking spaces to accommodate all the cars belonging to occupants and the construction of the same to city standards shall be completed within 60 days of final approval of such site plan by the city council. Notwithstanding the number of cars owned by the residents, parking for owner-occupied units must be provided at not less than one space per unit.

    D.

    Facilities secondary and subsidiary to primary use. In addition to dwelling units, a retirement housing complex may include special facilities and services for its residents such as a cafeteria and/or dining room, library, game room, swimming pool, jacuzzi, exercise room, arts and crafts facilities, greenhouse, housekeeping service, transportation service and related uses. The following subsidiary uses shall be permitted by right to provide on-site goods and services for elderly residents and their guests, but are not intended for use by the general public:

    1.

    Also allowed as a subsidiary use shall be a "child care center" operated by the residents;

    2.

    Snack bar with a maximum of 350 square feet per 100 dwelling units;

    3.

    Beauty and barber shop with a maximum of 250 square feet per 100 dwelling units or a maximum of 450 square feet per 100 dwelling units for combined operations;

    4.

    Convenience retail shop with maximum of 350 square feet per 100 dwelling units to provide for the sale of food items, nonprescription drugs, small household items, and gifts.

    E.

    Minimum safety standards. A retirement housing complex shall provide the following minimum safety standards for its residents and guests:

    1.

    All doors shall be of sufficient width to accommodate wheel chairs.

    2.

    All dwelling units and communal facilities shall be adaptable.

    3.

    Wherever steps are located, ramps or elevators shall be provided in addition.

    4.

    Cooking units shall have no open flame.

    5.

    Emergency signal facilities shall be provided in each dwelling unit, located three to four feet above floor level, and shall register a signal at a central location (s) to permit 24-hour-a-day monitoring.

    6.

    An intercommunicating telephone system that does not involve dial-type phones or require a series of numbers or codes to activate the system may be utilized to meet this requirement.

    7.

    Electrical outlets shall be located at least 24 inches above floor level.

    8.

    Grab bars shall be located around all tubs and showers.

    9.

    Toilet areas shall be adaptable for the installation of grab bars.

    10.

    All floor surfaces shall be nonskid.

    11.

    Central heating and air conditioning shall be individually adjustable for each residential unit.

    F.

    General area regulations. The retirement housing complex shall meet the district regulations for the MF-1 or MF-2 zoning districts except as follows:
